In October 2014, Mollie Murphy hosted a webinar for NRCPDS FMS Members at Boston College on various guidance impacting FMS providers.The webinar presented the guidance issued by the Department of Labor addressing unpaid sleep time, as well as methods for determining what time is spent on-duty and off-duty in shared living situations.The issue of joint employment and the expected upcoming sub-regulatory guidance on the topic are also discussed.
The webinar also presented the latest guidance from the IRS on Notice 2014-7, on the procedures that FMS Providers and taxpayers can follow to implement the Notice at this stage. The IRS is expected to issue finalized procedures in the future that may be different from the current guidance.
Finally, the latest Affordable Care Act IRS reporting regulations were discussed. These regulations affect large employers who are subject to the ACA employer mandate.
